These Terms of Service ("Terms") govern your access to and use of youformulated.com, including any content, functionality, products, and services offered on or through the site (the "Services"), operated by YouFormulated ("YouFormulated," "we," "us," or "our"). YouFormulated is powered by Shopify, which enables us to provide the Services to you.

By accessing or using the Services, creating an account, placing an order, or using our skin analysis feature, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the Services. Please also review our Privacy Policy, which describes how we collect, use, and disclose your personal information, and which is incorporated by reference into these Terms.

Overview

YouFormulated sells personal care and skincare products, and offers a skin analysis tool that provides personalized product and routine recommendations based on a photo you voluntarily upload or a questionnaire you complete. We reserve the right to update, change, or discontinue any aspect of the Services at any time.

Eligibility

You must be at least 18 years old, or the age of majority in the jurisdiction where you reside, to use the Services or place an order. By using the Services, you represent and warrant that you meet this requirement.

Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when creating your account and to update such information as needed. You agree to notify us immediately of any unauthorized use of your account at support@youformulated.com.

Products and Product Descriptions

All products sold through the Services are cosmetic products intended for external, topical use only. We attempt to describe and display our products, including their ingredients and intended use, as accurately as possible. However, we do not warrant that product descriptions, images, ingredient information, or other content available on the Services are accurate, complete, current, reliable, or error-free.

Nothing on the Services, including any product description, marketing language, or content generated by our skin analysis tool, is intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition, and none of our products are intended to function as drugs. Statements regarding product benefits reflect intended cosmetic effects only. If you have a persistent, severe, or worsening skin condition, please consult a licensed dermatologist or healthcare provider.

As with any new skincare or personal care product, we recommend performing a patch test on a small area of skin prior to full use, and discontinuing use immediately if irritation, redness, or discomfort occurs.

Skin Analysis Tool

The Services include an optional skin analysis feature that allows you to upload a photo of your face or skin, or to answer a guided questionnaire, in order to receive personalized product and routine recommendations ("Skin Analyzer"). Use of the Skin Analyzer, including any photo upload, is entirely voluntary. You may use the questionnaire-based option at any time if you prefer not to upload a photo.

The Skin Analyzer is not a medical device, is not intended to provide a medical diagnosis, and does not replace consultation with a licensed healthcare provider. Recommendations generated by the Skin Analyzer are based solely on the information and/or images you choose to submit and are provided for general informational and product-matching purposes only. We do not guarantee that any recommendation will be suitable for your specific skin, and individual results from any recommended product may vary.

By uploading a photo to the Skin Analyzer, you represent that the photo is your own image, or an image you otherwise have the legal right to submit, and that you consent to its use as described in our Privacy Policy. Please refer to our Privacy Policy for details regarding how uploaded photos and related information are collected, used, retained, and deleted.

Orders, Pricing, and Payment

All orders placed through the Services are subject to our acceptance and product availability. We reserve the right to refuse, limit, or cancel any order for any reason, including suspected fraud, pricing or listing errors, or unavailability of a product, and to limit or prohibit orders that, in our sole judgment, appear to be placed by resellers, distributors, or dealers.

Prices for products are subject to change at any time without notice. In the event a product is listed at an incorrect price due to a typographical, pricing, or technical error, we reserve the right to refuse or cancel any orders placed for that product, whether or not the order has been confirmed and your payment method charged.

Payment must be received in full before an order is processed and shipped. Payments are processed through Shopify and its supported third-party payment processors, and your use of any payment method is also subject to the applicable payment processor's terms and privacy practices.

Shipping and Delivery

Estimated processing and delivery times provided on our Shipping Policy page or at checkout are estimates only and are not guaranteed. Title and risk of loss for products you purchase pass to you upon our delivery of the product to the shipping carrier.

If your order is shipped outside of the United States, you are solely responsible for any customs duties, import taxes, or brokerage fees assessed by the destination country's customs authority upon arrival. These fees are separate from and not included in the product price or shipping cost charged at checkout, and are not collected, determined, or retained by YouFormulated.

Returns, Refunds, and Exchanges

Please refer to our Return & Refund Policy, available on the Services, for information regarding return eligibility, timeframes, and the process for returns, refunds, or exchanges. Due to the personal-care nature of our products, opened, used, or non-defective products may not be eligible for return except as required by applicable law.

Reviews and User Content

If you submit a product review, comment, or other content to the Services ("User Content"), you grant YouFormulated a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and publish that User Content in connection with the Services and our marketing, in any media. You represent that you own or have the necessary rights to the User Content you submit and that it does not violate the rights of any third party.

We reserve the right, but are not obligated, to monitor, edit, or remove any User Content that we determine, in our sole discretion, is unlawful, offensive, misleading, or otherwise objectionable.

Intellectual Property

All content available through the Services — including text, graphics, logos, images, product formulations as presented, the Skin Analyzer, and the overall look and feel of the Services — is owned by YouFormulated or our licensors and is protected by applicable copyright, trademark, and other intellectual property laws. Except as expressly permitted by these Terms, you may not copy, reproduce, distribute, modify, or create derivative works from any part of the Services without our prior written consent.

Prohibited Conduct

In connection with your use of the Services, you agree that you will not:

Use the Services for any unlawful purpose or in violation of any applicable local, state, national, or international law;

Upload any photo or content to the Skin Analyzer, or elsewhere on the Services, that is not your own or that you do not otherwise have the right to submit;

Attempt to gain unauthorized access to any portion of the Services, other user accounts, or any systems or networks connected to the Services;

Use any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission;

Interfere with, disrupt, or place an undue burden on the Services or the networks or services connected to the Services;

Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right to terminate or restrict your access to the Services, including any account you have created, if we determine, in our sole discretion, that you have violated these Terms.

Third-Party Services and Links

The Services are hosted by Shopify and may integrate with or link to third-party websites, applications, or services, including our fulfillment partner, payment processors, and analytics providers. We do not control and are not responsible for the content, functionality, or privacy and security practices of any third-party sites or services. Your interactions with any third party accessed through the Services are solely between you and that third party.

Disclaimers

THE SERVICES, ALL PRODUCTS, AND THE SKIN ANALYZER ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT OR RECOMMENDATION WILL MEET YOUR SPECIFIC NEEDS OR EXPECTATIONS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOUFORMULATED AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, OUR PRODUCTS, OR THE SKIN ANALYZER, WHETHER BASED IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE SIX MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless YouFormulated and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of a third party.

Dispute Resolution and Governing Law

These Terms, and any dispute arising out of or related to these Terms or the Services, shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.

Changes to These Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting to the Services, and the "Last updated" date at the top of these Terms will reflect the most recent revision. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
